Liquidation Information
Policyholders, claimants and creditors having claims against Driver’s Insurance Company (Driver’s) should have filed a proof of claim, together with proofs of loss with the Assistant Receiver no later than January 10, 2014. Proof of Claim forms received after January 10, 2014 will lose their statutory priority and may not receive a distribution of assets.
For the protection of policyholders, the Order of Liquidation activated the State Guaranty Funds in the states where Driver’s was licensed to do business. It is believed that most claimants will be protected by their State Guaranty Fund subject to statutory limitations. The claim files have been transferred to the appropriate State Guaranty Funds. Driver’s was placed into receivership for rehabilitation on January 31, 2013 and was amended on February 21, 2013 by the Oklahoma District Court. Subsequently, on May 13, 2013, the court entered an Order of Liquidation with a Finding of Insolvency.
Pursuant to the Order and in accordance with Title 36 OKLA STAT §2007, all policies of insurance with Driver’s Insurance Company shall be terminated and coverage under said policies were cancelled effective on Thursday, June 13, 2013 at 12:01 a.m. This notice did not extend coverage beyond any previous cancellation date but did supersede any cancellation or non-renewal effective after June 13, 2013.
